Our goal is to connect event organizers with their audiences by making their shopping/ticketing experience easy, efficient, safe and clear. It is important that you read these terms carefully and agree to them before listing your event or completing a purchase.
By accessing or using the Website either as an organizer of an event (each an “Event Organizer”) or as the purchaser of a ticket (each a “Buyer”), you agree to be bound by this Agreement, our Privacy Policy and all laws, rules and regulations applicable to your use of the Website. The Terms and Conditions may be updated from time to time.
This Terms of Use Agreement (this “Agreement”) is a legal agreement between you (“you” or “your”) and Ticketzia, its affiliates, and each of their respective successors and assigns (collectively, “Ticketzia,” “we,” “our” or “us”) governing your access to, and use of, the www.ticketzia.com website and all social media accounts, and other online products and services offered by Ticketzia (collectively, the “Website”) for the purchase and sale of tickets (the “Service”) and any documents or other materials associated therewith (the “Materials”).
Changes in terms and conditions
Ticketzia reserves the right to change or discontinue at any time any feature or aspect of the Ticketzia® service including, without constituting an exhaustive or exhaustive list, content, hours of availability and equipment necessary to access its use.
Ticketzia reserves the right to change or modify at any time the terms and conditions applicable to the use of the Ticketzia® service or any of its parts, or to impose new conditions, such as additional or modified fees and charges. Any change, modification or elimination will be effective immediately when published to the portal https://www.ticketzia.com or by any suitable means of notification. Any use of the Ticketzia® service that is subsequent to such notification will constitute acceptance of such changes, modifications, additions or deletions.
Acceptable Uses
You may use Ticketzia® services for legal purposes only. Any conduct that Ticketzia considers that potentially generates civil liability or violates any law, or that in any other way restricts or prevents the use and enjoyment of the Ticketzia® service by any other user is prohibited.
By registering your event on the Website, you agree that you are solely responsible for any and all acts and omissions that occur while you use the Website, and you agree not to engage in unacceptable use of the Website. Ticketzia reserves the right to permanently remove your content, your event listing and or your account from Ticketzia, for any reason and to take any legal action that is otherwise necessary to enforce this Agreement. This includes unacceptable use of the Service, violations of this Agreement, or violation of the terms of services of our payment processors.
Ticketzia has sole discretion over what is deemed acceptable or unacceptable use. Your content must be genuine, honest and not fraudulent. You may not use the Website to post content (including photos, logos, videos and copy) or engage in any conduct that is fraudulent, offensive, illegal, harmful, or inappropriate for general audiences.
Ticketzia provides an event registration and ticketing platform for event organizers to offer tickets to their own events. The Website may not be used to resell tickets or sell tickets to any event of which you are not the owner or organizer. You may not use the Website to sell
material goods or merchandise unless it is related to an event being hosted on the Website.
Use at your own risk
You expressly agree that you will use the Ticketzia® service at your own risk. You will be responsible for protecting the confidentiality of your password, if any, and of all activity that occurs under your account.
Service Guarantee
The Ticketzia service is provided as is (“as is”), without express or implied warranties of any kind (including without being an exhaustive or exhaustive list, guarantees of title or implicit guarantees of merchantability or suitability for a particular use) , other than those implicit guarantees or not subject to exclusion, restriction or modification under the laws applicable to this agreement.
Ticketzia, its officers, directors, employees, shareholders, agents, content providers or licensors or assignors do not guarantee a service free from interruptions or errors. Nor do they guarantee the results that may be obtained from the use of the Ticketzia service, the acquisition of tickets or the precision, accuracy and correctness of any information, service or merchandise provided through the Ticketzia service.
Disclaimer
This disclaimer applies to any damages caused by lack of compliance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, failure in communication lines, theft or destruction or unauthorized access, be it for breach of contract, tortious actions, negligence or any other cause of action. You specifically acknowledge that Ticketzia and its agents are not responsible for defamatory, offensive or illegal conduct of other users or third parties and that the risk of harm for the foregoing rests entirely with you.
Third Party Service Providers
Certain portions of a Transaction may be processed by third party service providers (e.g., PayPal, Wipay) (“Third Party Service Providers”). Such processing services are subject to the terms and conditions and fee descriptions made available by the Third Party Service Providers. You must accept the terms of the Third Party Service Provider and their fees prior to completing a Transaction. Ticketzia assumes no responsibility for services offered by Third Party Service Providers.
Term of Sale
Each ticket purchased by Buyer is a license to attend a specific event granted by the Event Organizer. ALL SALES ARE FINAL; NO REFUNDS OR EXCHANGES. Tickets sold through the Website grant a revocable license to the Buyer that may be revoked at any time for any reason without compensation. Resale or attempted resale of any ticket issued hereunder at a price higher than the face value appearing thereon is grounds for seizure and cancellation without compensation. The Buyer assumes all risk or danger incidental to the attraction, whether occurring prior to, during, or subsequent to, the actual attraction. The terms of sale of each ticket issued pursuant to a Transaction initiated on the Website are subject to any and all terms imposed by the applicable Event Organizer. In order to be admitted to an event, each Buyer must present the original ticket in its original, undamaged, unaltered form, to the applicable venue at the appropriate time. Entry may be refused for various reasons, including misconduct, failure to comply with any safety and health policies required by the venue where you will attend any event, intoxication, etc., as determined by the Event Organizer (in its sole discretion). If you are refused entry for any such reason, you shall not be eligible for any refund or compensation from Ticketzia.
Fees
You agree to pay all fees in accordance with the fee descriptions published by Ticketzia on the Website and any other fees applicable to a Transaction. Fees are subject to change without prior notice at any time, so you should review the fees each time you use the Website. These may also include additional charges that are not established by Ticketzia and that may not necessarily be optional. The price established on the ticket (“ticket”) that gives you access to a face-to-face or online event represents the cost of admission and does not necessarily include all applicable service and processing charges.
Notwithstanding anything to the contrary herein, in the event of any refunds of Transactions by an Event Organizer (or the cancellation of any events associated with such Transactions) and/or any Force Majeure event, you agree that Ticketzia shall be entitled to retain any fees charged by Ticketzia in connection with its processing and facilitation of any such Transactions. The charges for the services that Ticketzia offers when processing an order are not refundable
